Sai Kung's Poseidon Operation

STT Breaches


Sai Kung District Lands Office has recently begun a project designed to “tackle breaches in short term tenancies (STT) in Sai Kung District”.

 

Evidently the project, dubbed “The Poseidon Operation”, is a result of a survey of all existing STT which was finished at the end of 2006.

 

Tackling the more major breaches first – the Poseidon Operation Team issued warning letters to all tenants determined to be in this category this past September, requesting that they “rectify the irregularities” within a specified time.

 

According to the DLO, major breach cases can be classified in three categories:

  • the tenancy area has been enlarged by over 30%, or
  • the permitted built-over area within the tenancy area has been enlarged by over 30%, or
  • there has been a change of the permitted user.

 

Follow-up action will be taken on a case by case basis. “If the breach is not rectified”, they say, "action taken includes termination of tenancy, physical clearance and prosecution.

Application for regularization of the breaches is not encouraged and will be considered on the merit of each case”.
